If you receive a Notice of Intended Prosecution (NIP) otherwise known as a speeding ticket after either being stopped by police officers or caught by a speed camera there are a number of ways in which you could be punished. This could include a speed awareness course or a Fixed Penalty of 3 points and a £100 fine. Alternatively you could be dealt with by the Court and receive up to 6 points or a period of disqualification from driving and a fine.

Do time limits apply to receive a NIP?

Within 14 days of the offence a notice of intended prosecution must be given to the driver or registered keeper of the vehicle. The first day for calculating the 14 days is the day after the offence, therefore the NIP must be dated within 14 days of the offence. It could arrive later than 14 days as long as it is dated and sent within that period. If it is not dated within the 14 days it may be invalid. It is important that you seek advice on this point as an accumulation of penalty points could lead to a period of disqualification. If you were warned by officers at the time of the offence that you are liable for prosecution there is no requirement to serve a NIP.

You must complete the Section 172 and return it to the police within 28 days confirming who was driving. If you were not driving you must confirm who was driving at the time of the offence. If you do not comply with this you could be committing an offence of failing to provide driver details. Once you have returned to Section 172 you will either receive a conditional offer of a Fixed Penalty Notice (FPN) from the police that may also offer a speed awareness course or if you are not eligible you will receive points and a fine.

There are strict time limits to accept an FPN or complete a speed awareness course. If these time limits are not complied with you are likely to receive points and a fine.
