Reviewing the property title
The first step in completing a transfer of equity will typically be to request a copy of the existing property title. Your solicitor will take a detailed look over the title so they can confirm the current ownership, including the identity of the current and planned property owners. Additionally, your solicitor will check for any existing charges, such as a mortgage,
If a mortgage is in place, we will liaise with the relevant mortgage provider so they can conduct the necessary checks and give their approval for the transfer of equity to proceed.
At this stage, our team will be in contact with all of the relevant parties before proceeding to prepare the relevant transfer deeds for a change in ownership.
Organising the transfer deed
After the title has been reviewed and the new transfer deed has been prepared, all parties involved (including the existing and future property owners) will review and sign the transfer deed (the legal document proving the title on the property), with a witness present to oversee the signing of the documents.
Registering the transfer with HM Land Registry
The Transfer of Equity will need to be registered with HM Land Registry to update the title deeds to the property. This is something our solicitors can do on your behalf.
