New legislation came into force on 25th March 2022 that prohibits the use, while driving a motor vehicle, of hand-held mobile telephones or other interactive communication devices, when performing an interactive communication function. This widens the offence to remove the requirement that the driver is using a mobile phone and will now include other interactive devices for example mp3 players, or a tablet, performing interactive communication functions.

It is recorded that the increase in people caught driving whilst using their mobile phone in Leicestershire has increased by nearly 5% in 2023, compared to the figures in 2020.

The rise in people having their driving licence endorsed has therefore increased, meaning there are more drivers on the road with 6 penalty points and at risk of losing their licence.

How can we help?

If you find yourself being prosecuted for use of a mobile phone whilst driving or any other motoring offences, it is vital to contact a solicitor as soon as possible to obtain expert legal advice.

If you find that you are already driving around with points on your licence and receive a notice of intention to prosecute for driving whilst using your mobile phone, you could be at risk of losing your licence. To avoid losing your licence, it is vital that you seek legal advice, as here at Johnson Astills, we are able to put forward successful arguments to prevent drivers losing their licence.
