Nitrous Oxide & Beyond...
Johnson Astills have seen an increase in the number of cases before the Courts involving newer synthetic drugs. The offences were created by the Psychoactive Substances Act 2016 which came into force on 26th May 2016. The Sentencing Council has published new guidance to assist in the sentencing of these offences.
Guidance Not Guidelines
The aim of this new guidance is to address the harm caused by these newer drugs, however it is important to note that whilst this is guidance to assist sentencers in how to deal with these cases, they are not obliged to follow it.
In the coming months the Sentencing Council will be consulting on the revised guidelines and further developments are anticipated.
