New Drug Sentencing Guidelines

The new drug definitive sentencing guidelines came into force on 27th February 2012 across England and Wales. The new guidelines envisages the difference between those who are pressured into drug trading and organised criminal drug gangs. The guidelines would promote a more consistent approach to sentencing across all the courts in England and Wales. The guidelines have separated the different levels of sentencing depending on the role undertaken (inter alia) by the defendant in the drug trade. Under the guidelines, an individual that was coerced into smuggling a class C drug into the country can be given a community order. Whilst, an individual found to have a large amount of cash and evidence to suggest their role is not minor, may attract a lengthy custodial sentence.
